This release, made by Customer with regard to NCT DIESEL their principals, partners, agents or assigns: hereinafter, Agent. It is understood that:
1) Customer desires Agent to operate his vehicle for the purposes of testing, evaluation, or mechanical service.
2) Customer grants permission for Agent to operate his vehicle in any manner it deems appropriate, including operation on and off chassis dynamometer, and assumes full liability for loss or damage during said operation. Customer agrees that Agent is not responsible for any loss or damage to his vehicle or person as a result of the operation of same. Agent has made no representations other than those expressly made herein. No warranties or guarantees have been made to Customer who expressly acknowledges and understands the following:
A) Vehicles can and do suffer serious and catastrophic damage during or after operation on a Dynamometer. A Dynamometer pushes a vehicle and many of its mechanical components to critical levels which by its very nature may cause failure of those components. Automobiles are inherently unpredictable and unsafe, and operating or riding in a vehicle can lead to serious injury or death.
B) Customer agrees that all risk of loss or damage to his vehicle or person with regard to operation of his vehicle by Agent remains with him.
THE BOTTOM LINE: CUSTOMER IS RESPONSIBLE FOR EVERYTHING INCLUDING ANY DETERMINATION OF ROAD WORTHINESS OR SAFETY OF HIS VEHICLE AFTER OPERATION BY AGENT, AND EXPRESSLY ACKNOWLEDGES THAT AGENT IS NOT RESPONSIBLE FOR ANY LOSS OR DAMAGE TO HIS VEHICLE OR PERSON AS A RESULT OR THIS OPERATION AND HEREBY RELEASES, DISCHARAGES, AND INDEMNIFIES AGENT FOR ANY AND ALL CAUSES OF ACTION ARISING AS A RESULT OF THE OPERATION OF HIS VEHICLE BY AGENT. I have read the foregoing document in its entirety and understand the terms and conditions contained herein. This release is continuing in nature and shall apply to this and any other vehicle I own or have control over which I deliver to Agent.
